Terms of Service for Smailpro

1. Introduction & Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and SmailPro ("we", "us", "our", "Company"), governing your access to and use of the website located at https://smailpro.com, all associated subdomains, browser extensions, mobile applications, and REST API services (collectively, the "Service").

By accessing or using the Service in any way — including browsing the website, creating a temporary email address, or subscribing to a paid plan — you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the Service immediately.

These Terms are governed by the laws of Vietnam. We may update these Terms at any time. The most current version will always be available at https://smailpro.com/terms. Continued use of the Service after any update constitutes acceptance of the revised Terms.

2. Service Description

2.1 What SmailPro Is

SmailPro provides temporary, disposable email addresses that allow users to receive incoming emails without disclosing their personal email address. The Service operates across three categories of email addresses:

  • Temporary Gmail — Proxy access to a rotating pool of real @gmail.com and @googlemail.com addresses maintained by SmailPro on Google's infrastructure.
  • Temporary Outlook — Proxy access to a rotating pool of real @outlook.com and @hotmail.com addresses maintained by SmailPro on Microsoft's infrastructure.
  • Temporary Regular Domains — Disposable addresses across 20+ domains (e.g. storegmail.net, smser.net, cardgener.com) operated directly by SmailPro.

2.2 Critical Service Limitations — Read Before Use

The following characteristics are fundamental to how SmailPro works. By using the Service, you acknowledge and accept these limitations:

Receive-only SmailPro is strictly an email-receiving service. You cannot send outgoing emails from any SmailPro address. No send capability exists at this time.
Read-only access For Gmail and Outlook addresses, you are granted temporary, read-only access to view received messages. You do not receive account credentials, passwords, or the ability to log into gmail.com or outlook.com directly.
No ownership You do not own, control, or have exclusive rights to any email address provided. Addresses are drawn from a shared pool and may be reassigned to other users after your session ends.
Proxy model Gmail and Outlook addresses remain the property of their respective providers (Google LLC and Microsoft Corporation). SmailPro provides proxied access to inboxes, not ownership of those accounts.
Temporary by design Sessions and email data are automatically purged upon session end or creation of a new address. No permanent email history is guaranteed.
No account credentials SmailPro staff do not possess and cannot provide Gmail or Outlook login passwords.

2.3 Buyer Email vs. Temporary Inbox

Your billing/purchase email address (the real email address you provide during subscription checkout) is entirely separate from the temporary email addresses you use as the product. Your billing email is used solely for payment processing, subscription management, and customer support. It is never used as a temporary inbox or shared with third parties for marketing.

2.4 Service Availability Disclaimer

Gmail and Outlook accounts within our pool are subject to termination by their respective providers (Google and Microsoft) at any time, without notice to SmailPro. While we continuously monitor and replace terminated accounts, we cannot guarantee the continuous availability of any specific address. In the event of widespread account termination, service interruptions may occur. SmailPro is not liable for disruptions caused by third-party provider actions.

3. Acceptable Use Policy (AUP)

This Acceptable Use Policy is a binding part of these Terms. Violation of this AUP may result in immediate account termination, refund forfeiture, and/or reporting to relevant authorities.

3.1 Permitted Uses

SmailPro is designed for legitimate privacy-protective purposes, including:

  • Protecting your personal email from spam and data harvesting when signing up for online services.
  • Testing email delivery and verification flows during software development.
  • Receiving one-time verification codes (OTPs) from services.
  • Signing up for newsletters, trials, or promotions you wish to evaluate before committing your primary address.
  • Academic research and security testing in authorised environments.

3.2 Prohibited Uses

The following uses are strictly prohibited and constitute grounds for immediate termination without refund:

(a) Identity Fraud & Impersonation

  • Using SmailPro to impersonate another person, business, organization, or government entity.
  • Creating accounts on third-party services while falsely claiming to be someone else.
  • Identity theft or identity fraud of any kind.

(b) Financial Fraud & Illegal Activity

  • Using SmailPro to bypass Know Your Customer (KYC) verification on financial institutions, cryptocurrency exchanges, payment processors, or any regulated financial service.
  • Bypassing Anti-Money Laundering (AML) checks or age verification systems on financial, gambling, or adult platforms.
  • Facilitating credit card fraud, bank fraud, insurance fraud, or any other form of financial crime.
  • Opening fraudulent accounts to claim sign-up bonuses, referral rewards, or promotional credits in violation of a platform's terms.

(c) Spam, Phishing & Malware

  • Distributing unsolicited commercial messages (spam) using addresses or infrastructure associated with SmailPro.
  • Operating phishing campaigns, credential harvesting, or social engineering attacks.
  • Distributing malware, ransomware, spyware, or any malicious software.
  • Using the Service to receive stolen credentials or facilitate data breaches.

(d) Illegal Content & Harmful Activity

  • Receiving, transmitting, or facilitating child sexual abuse material (CSAM) in any form. Such activity will be immediately reported to relevant law enforcement authorities including the National Center for Missing & Exploited Children (NCMEC).
  • Receiving or facilitating content related to harassment, stalking, threats, or incitement to violence.
  • Using the Service in connection with terrorism financing, human trafficking, or any other serious criminal activity.

(e) Platform Abuse

  • Systematically creating accounts on platforms that explicitly prohibit temporary or disposable email addresses in their terms, for the purpose of circumventing those restrictions at scale (account farming).
  • Creating multiple fraudulent accounts on a single platform to manipulate reviews, votes, or engagement metrics.
  • Selling or reselling access to SmailPro temporary addresses to third parties outside of our official API reseller program.

(f) Service Abuse

  • Attempting to reverse-engineer, scrape, or extract the full contents of our Gmail or Outlook account pool.
  • Using automated tools to exhaust address pools or degrade service quality for other users.
  • Attempting to gain unauthorized access to Gmail or Outlook accounts beyond the inbox access provided.
  • Circumventing any technical measures that limit access to certain features.

3.3 Grey Area — User Responsibility

SmailPro recognizes that temporary email has legitimate uses on platforms that discourage disposable domains. Using SmailPro to sign up for a service where temporary email is not explicitly prohibited by that service's terms is the user's responsibility to evaluate. SmailPro does not endorse violations of third-party service terms and is not liable for consequences arising from such violations.

4. Subscription & Billing Terms

4.1 Plans

SmailPro offers a Free Plan with limited features at no cost, and a Premium Plan at $2.99 USD per month.

4.2 Billing Cycle & Auto-Renewal

Premium subscriptions are billed on a monthly recurring basis. Your subscription will automatically renew at the end of each billing period at the then-current price unless you cancel prior to the renewal date. By subscribing, you authorize us (or our payment processor) to charge your payment method on a recurring basis.

4.3 Payment Processing

Payments are processed by our authorized payment processors. SmailPro does not store raw credit card data. Accepted payment methods include:

  • Credit/Debit Cards: Visa, Mastercard, American Express, Discover, JCB
  • PayPal
  • Cryptocurrencies: Bitcoin, Ethereum, Litecoin, Ripple, and others as available.

4.4 Cancellation

You may cancel your Premium subscription at any time through your account dashboard or by contacting support. Cancellation stops future billing. Your Premium access remains active until the end of the current paid billing period. We do not offer prorated refunds for partial months unless required by applicable law or as specified in Section 5 below.

4.5 Price Changes

We reserve the right to change the subscription price with at least 14 days' notice communicated via email to your billing address or a notice on the website. If you do not cancel before the price change takes effect, you consent to the new price.

4.6 Failed Payments

If a payment fails, we may retry the charge. If payment remains unsuccessful after reasonable attempts, your account may be downgraded to the Free Plan.

5. Refund Policy

5.1 30-Day Money-Back Guarantee

We offer a 30-day no-questions-asked refund on Premium subscriptions. If you are unsatisfied with the Service for any reason within 30 days of your initial subscription purchase, contact us at support@sonjj.com and we will issue a full refund to your original payment method.

5.2 Refund Eligibility

  • Eligible: First-time subscribers within 30 days of initial purchase.
  • Not eligible: Refund requests made after 30 days of the purchase date; subsequent billing cycles (renewals) after the initial 30-day window; accounts found to be in violation of the Acceptable Use Policy.

5.3 Refund Processing

Approved refunds are processed within 5–10 business days. Processing time to your account depends on your bank or payment provider. Cryptocurrency payments are refunded in USD equivalent at the exchange rate at the time of the original transaction, or at our discretion.

5.4 Statutory Rights

This refund policy does not affect any statutory rights you may have under applicable consumer protection law.

6. User Accounts & Registration

6.1 Free Users

Free features of SmailPro (basic temporary email) do not require registration. Anonymous access is intentional and supported.

6.2 Premium Accounts

Premium subscription requires provision of a valid billing email address and payment information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@smailpro.com if you suspect unauthorized use of your account.

6.3 Account Termination

We reserve the right to suspend or terminate accounts, without prior notice, that violate these Terms — particularly the Acceptable Use Policy. Terminated accounts for AUP violations are not eligible for refunds.

7. API Access

Access to the SmailPro REST API requires a valid API key obtained from https://my.sonjj.com. API usage is subject to these Terms, including the Acceptable Use Policy. Rate limits apply and are subject to change. Unauthorized access attempts, scraping without an API key, or API abuse constitutes a violation of these Terms and may result in IP blocking and legal action.

8. Intellectual Property

All website content, trademarks, logos, software, and proprietary systems are owned by SmailPro or licensed to us. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Service without our prior written consent. Your use of the Service grants no ownership rights over our intellectual property.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, available at https://smailpro.com/privacy, which is incorporated into these Terms by reference. Key privacy principles include:

  • Zero-log policy: SmailPro does not log your IP address, browsing behaviour, or the content of emails you receive beyond the active session.
  • Proxy model disclosure: For Gmail and Outlook addresses, email content is stored on Google and Microsoft infrastructure, not on SmailPro servers. SmailPro fetches content for display and purges it upon session end.
  • Data minimization: We collect only what is necessary to operate the Service.
  • Billing data separation: Your billing email is processed separately from any temporary addresses you use and is not linked to your inbox usage patterns.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or continuously available;
  • Any particular Gmail or Outlook address will remain in the pool or pass verification on any specific third-party platform;
  • Emails will be delivered within any specified timeframe;
  • Account bans by Google or Microsoft will not occur.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMAILPRO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, OR LOSS OF BUSINESS OPPORTUNITY.

IN NO EVENT SHALL SMAILPRO'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SMAILPRO IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) USD $10.

This limitation applies regardless of the legal theory under which damages are sought.

12. Indemnification

You agree to indemnify, defend, and hold harmless SmailPro, its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms, including the Acceptable Use Policy; (c) your violation of any applicable law or the rights of any third party.

SmailPro's Service involves access to third-party infrastructure (Google, Microsoft). We are not affiliated with, endorsed by, or agents of Google LLC or Microsoft Corporation. Your interactions with these platforms through our Service remain subject to their respective Terms of Service and Privacy Policies.

The Service may contain links to external websites. We are not responsible for the content, privacy practices, or availability of third-party websites.

14. DMCA & Abuse Reporting

If you believe content accessible through the Service infringes your intellectual property rights, or if you wish to report abuse (including illegal content, CSAM, or AUP violations), contact us immediately:

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the competent courts of Vietnam.

Any claim must be brought within one (1) year of the date the cause of action arose, or it will be permanently barred.

16. General Provisions

  • Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
  • Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of that or any other provision.
  • Entire Agreement: These Terms, together with the Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and SmailPro with respect to the Service.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely.
  • Language: These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version shall prevail.
